Con-court dismisses rights group application

The constitutional court has today handed down its decision dismissing an application by rights group, Transformation Resource Centre, challenging credibility of Independent Electoral Commission (IEC) commissioner’s selection process.
Constitutional court dismissed the application on grounds that the rights group does not have legal standing and that it has failed to show that it is a rightful petitioner hence its lack of capacity to appear in court contesting the selection process.
Acting Chief Justice ‘Maseforo Mahase, said the duty to make the commissioners’ selection relied solely on the Council of state and as such, the applicants prematurely approached the constitutional court.
Moreover, Justice Keketso Moahloli, said the court has no jurisdiction to deal with the matter.
The judgment was delivered by both Justice Mahase and Justice Moahloli. Upon the delivery, Justice Mahase pointed they had previously been working with the deceased judge, Justice Lebohang Molete on the case.
She also highlighted that following the loss of a number of judges through both death and retirement, they (judges) have been working under a lot of pressure as they are short-staffed.
KDNews learned that just when Justice Mahase had to attend to another case, she was also obligated to hand down the TRC judgment.
The TRC wanted the court to nullify the appointments of the IEC commissioners as it contended that such appointments were unconstitutional.
